Terms of Use

These terms govern your use of OptyPeptides. For OptyPeptides, they replace the OptiSelf Terms of Use previously at optiself.co, which still cover OptySleep and other OptiSelf products. The old data license and commercialization sections are gone: how we collect, use, share and sell information is now set out in our privacy documents.

1. Who these Terms cover

These Terms of Use (“Terms”) govern your use of OptyPeptides: the iPhone and Android apps, the clinic admin portal, this website, the AI features and the related services provided by OptiSelf LLC (“OptiSelf”, “we”, “us”) (the “Services”). By creating an account or using the Services, you agree to these Terms. If you don’t agree, don’t use the Services.

How we collect, use, share and sell information is described in the OptyPeptides Privacy Policy, which is part of these Terms, together with our Consumer Health Data Privacy Policy and Your Privacy Choices. If you use OptyPeptides through a clinic, the clinic’s own agreements with us also apply to your clinic’s records.

2. Not medical advice

The Services are for general information, education and self-tracking. They do not provide medical advice, diagnosis or treatment. OptiSelf is not a physician, pharmacy, clinic, laboratory or emergency service.

Nothing in the Services, including tracking, trends, scores, reminders, summaries and AI output, replaces the judgment of a licensed healthcare professional. Talk to a qualified professional before starting, changing or stopping any medication, peptide, supplement, hormone, dose or health routine. If you think you have a medical emergency, call 911 or your local emergency number.

3. No provider relationship

Using the Services does not create a doctor-patient or other professional relationship with OptiSelf. We do not prescribe, dispense, sell, compound or administer any medication, peptide, supplement or controlled substance.

If you use the Services through a clinic, the clinic and its licensed providers are responsible for your care. OptiSelf provides the software.

4. Your account

You must be at least 18 to use the Services. You agree to give accurate information, keep your sign-in details private, and tell us at hello@optypeptides.com if you think someone else has used your account. You are responsible for activity under your account.

5. Acceptable use

You agree not to:

• use the Services for anything unlawful, or to harm anyone;
• access another person’s account or data, or try to get around security or access controls;
• probe, scan or test the Services for vulnerabilities without our written permission;
• copy, reverse engineer or resell the Services, except where the law allows it;
• try to re-identify any person from de-identified or aggregated data, whether obtained from us or anyone else;
• upload anything you don’t have the right to share.

6. Your information

You own the information you enter, upload or connect (“User Data”). You give us a license to host, store, process, display and transmit User Data as needed to run, secure, support and improve the Services, and as described in the Privacy Policy.

The Privacy Policy explains, among other things, when we create de-identified data, when we sell data, and the separate permission we ask for before selling information that identifies you. Nothing in these Terms permits us to sell information that identifies you without that permission.

You’re responsible for the accuracy of what you enter, and for having the right to share anything you upload.

7. AI features

Some features use artificial intelligence, such as the assistant, lab-report reading and summaries. AI output can be incomplete or wrong. It isn’t medical advice, and you should check it with a qualified professional before acting on it.

We don’t use protected health information, or any information that identifies you, to train or improve any AI model. Our AI features run on Amazon Bedrock in our own AWS account, under our Business Associate Agreement with AWS. Neither AWS nor the model’s maker, Anthropic, uses what you send or receive to train any model, and Anthropic never sees it.

8. Peptides, supplements and other substances

Information about peptides, supplements, hormones or other compounds is general information only. OptiSelf does not recommend, endorse or guarantee the safety, legality, purity, sourcing, dosage or effectiveness of any substance or protocol. You are responsible for following the law where you live and for getting products only through lawful channels.

9. Risk and results

Health decisions carry real risk, including side effects, interactions, injury and death. You use the Services at your own risk and are responsible for your own health decisions and their outcomes. Results vary, and we don’t guarantee any outcome.

10. Third-party services

The Services can connect to devices and services we don’t control, such as Apple Health, Android Health Connect, Whoop, Oura and Garmin. Their own terms and privacy policies apply to them. We aren’t responsible for their accuracy, availability or security.

11. Security

We use safeguards appropriate to health information, described in the Privacy Policy. No system is completely secure, and we can’t guarantee that unauthorized access will never happen. If a breach affects your information, we’ll notify you or your clinic as the law requires.

12. Subscriptions and fees

Some features may require payment. Prices, billing terms and any trial are shown before you buy. Clinic subscriptions are governed by the clinic’s Clinic Subscription Agreement.

13. Changes

We may change the Services or these Terms. If a change is material, we’ll tell you in the app or by email before it takes effect. Continuing to use the Services after a change takes effect means you accept it.

14. Ending your use

You can stop using the Services and delete your account at any time, as described in the Privacy Policy. We may suspend or end your access if you break these Terms, create a security or legal risk, or if we stop offering a Service. Sections 5, 6, 9 and 15–20 survive after your account ends.

15. Disclaimer of warranties

TO THE FULLEST EXTENT THE LAW ALLOWS, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. OPTISELF DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY.

16. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, OPTISELF AND ITS OWNERS, OFFICERS, EMPLOYEES AND CONTRACTORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF US $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM. SOME PLACES DON’T ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.

17. Indemnity

You agree to defend and indemnify OptiSelf against claims arising from your breach of these Terms, your violation of law, or your misuse of the Services.

18. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes will be brought only in the state or federal courts in Travis County, Texas, and you consent to their jurisdiction.

19. General

If any part of these Terms is unenforceable, the rest stays in effect. Our failure to enforce a term is not a waiver. These Terms, the Privacy Policy and any purchase terms shown to you are the entire agreement between you and OptiSelf about the Services.
